These Terms of Use ("Terms") govern access to and use of the Trilhabela Turismo website and the booking of the guided ecotourism tours we offer in Ilhabela, state of São Paulo, Brazil. Please read them carefully before browsing the site or booking any activity.
1. Acceptance of the Terms
By accessing this website, submitting a booking request and/or taking part in any of our activities, you declare that you have read, understood and fully accepted these Terms, as well as our Privacy Policy. If you do not agree with any of the conditions described here, please do not use the site or book our services.
Your acceptance also binds the people for whom you make the booking (companions, family members, minors under your responsibility), so it is your responsibility to inform them of the content of these Terms.
2. Who we are and our services
Trilhabela Turismo is an ecotourism operator specialising in guided experiences in Ilhabela and the surrounding region. We work with local guides and partner providers to offer, among others, the following activities:
- Hiking trails and crossings through the Ilhabela State Park and other natural areas;
- Visits to waterfalls and natural pools;
- Boat and schooner tours along the coast and islands;
- 4x4 (jeep) tours on dirt roads and hard-to-reach beaches;
- Diving and marine wildlife activities;
- Whale watching in season.
The activities take place outdoors and in natural settings, many of them within conservation units, which imposes mandatory safety and environmental preservation rules.
3. Bookings and confirmation
Booking requests may be made through our WhatsApp, the website or the online store. Every request is subject to confirmation by Trilhabela Turismo and is not considered guaranteed until we issue the corresponding confirmation.
Confirmation depends on the availability of dates and spots, on the minimum and maximum number of participants for each activity, and on weather, tide and sea conditions. We may request participant details (name, contact and, where relevant, health information) in order to organise the operation safely.
4. Prices and payment
Prices are stated per person or per group, depending on the activity, according to the price list in force at the time of booking. Some tours may require payment of a deposit to secure the spot, with the remaining balance payable as agreed.
Online payments are processed through the InfinitePay platform or other methods we make available. Prices may be updated at any time before the booking is confirmed; once confirmed, the agreed amount is honoured. Any taxes, park access fees or third-party costs will be informed where applicable.
5. Cancellation, rescheduling and weather conditions
As these are outdoor activities, participant safety is the priority. Trilhabela Turismo may reschedule or cancel an activity in the event of adverse weather, sea or tide conditions, alerts from the competent authorities, or any situation that compromises safety.
- If we cancel for safety reasons or force majeure, we will offer rescheduling to another date or, when this is not possible, a refund of amounts paid for the activity that did not take place.
- Cancellations or changes requested by the customer must be communicated through our contact channels as far in advance as possible; the refund or rescheduling conditions will be informed at the time of booking and may vary by activity.
- In the event of no-show or a delay that prevents the safe running of the activity, there may be no right to a refund.
6. Participant responsibilities
For your own safety and that of the group, the participant agrees to:
- Inform us, before the activity, of any health conditions, physical limitations, use of medication, pregnancy or any relevant restriction;
- Be in a physical condition compatible with the level of effort of the chosen activity;
- Fully follow the guide's orientations and instructions throughout the tour;
- Use the safety equipment provided and appropriate footwear and clothing;
- Respect the environment, fauna and flora, leaving no litter and removing no natural elements, and complying with the rules of the Ilhabela State Park and other conservation units.
Failure to comply with these obligations may lead to the interruption of the activity, without the right to a refund, when it compromises the safety of the participant or of others.
7. Inherent risks and risk-awareness statement
Adventure and ecotourism activities involve inherent risks that cannot be completely eliminated, such as uneven terrain, water currents, sea conditions, wildlife and weather variations. By taking part, the customer declares that they are aware of these risks and consciously assume them.
Where the activity requires it, we may ask you to sign a Risk-Awareness Statement (TCR), detailing the specific risks and safety measures. Signing the TCR is a condition for taking part in certain activities.
8. Limitation of liability
To the extent permitted by applicable law, Trilhabela Turismo shall not be liable for damages arising from acts of God or force majeure, from the participant's failure to follow safety orientations, or for the loss, damage or misplacement of personal belongings during the activities.
Nothing in these Terms excludes or limits liabilities that cannot be legally excluded under the Consumer Protection Code and other applicable laws.
9. Intellectual property
The "Trilhabela" brand, as well as the texts, photographs, videos, designs and other content on this site, are protected by intellectual property law and belong to Trilhabela Turismo or its licensors. Reproduction, distribution or commercial use of any content without prior written authorisation is prohibited.
10. Use of image
During the tours we may capture photographs and videos for record-keeping and for promotion on social media and marketing materials. By taking part, the customer authorises this use free of charge. If you prefer not to appear, or wish to request the removal of an image already published, you may let us know through our contact channels and we will handle the request.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, including the Consumer Protection Code and the General Data Protection Law (Law No. 13,709/2018 - LGPD). To settle any dispute arising from these Terms, the parties elect the jurisdiction of the District of Ilhabela, State of São Paulo, Brazil, waiving any other, however privileged it may be.
12. Changes to these Terms
We may update these Terms at any time to reflect changes in our services or in the law. The version in force will always be available on this site, with the date of the last update. Continued use of the site or our services after changes are published implies acceptance of the updated version.
